1.Duties of employer in an employment contract are as follows:
The working hours for private sector are 8 hours per day. The working hours can be increased for certain businesses after seeking approval from MoHRE.
The Wage Protection System ensures protecting the workers’ rights. Under WPS, salaries are transferred directly to the bank accounts of employees.
Article 91 to 101 of the UAE Labour law require the employer to maintain a safe and hygienic workplace.
Employees should provide appropriate apparatus to their employees for protection against injuries and potential hazards/accidents
In case an employee dies at workplace or gets injured, the article 149 of UAE Labor Law states that compensation shall be provided by the employer. The compensation shall be equal to the basic wage of 24 months.
2. Duties of employee in an employment contract are as follows:
The employee must ensure that he works in UAE with a contract or labor card.
The contract must state the nature of work, the workplace, the remuneration.
An employee cannot be terminated without prior notice if he does not violate the terms of contract.
An employee is entitled to insurance, gratuity and other employment benefits.
3.In UAE, it is illegal to work without a labor contract/card. In case of a dispute that arises between an employer and an employee, a complaint shall be filed to the labor department which will try to settle the dispute between both parties. However if no settlement takes place, the concerned labor department refers the case to the Court. After receiving the application, the Court holds a session by calling representatives from both parties. However, if the complaint is brought after a year from the date of entitlement, there will be no claim from any party.
