Samaritan Law:- Good Samaritan Law states that a Good
Samaritan cannot be made liable for damages in the court of law due
to some error made by the Samaritan while providing emergency
medical care.
Purpose of Good samaritan Law:-
- In a litigious society, there can be a reluctance to help out
in emergency situations. Fear of liability for any misstep can
paralyze even the most helpful good Samaritan.
- In an emergency , good samaritans who provide reasonable care
without the intention to harm are protected by law from
liability.
- The main purpose of this is to do justice and assist and help
those who are in need. By offering assistance to those who are in
need, injured or ill the legal protection passed on to these people
will protect them from their condition.
- Good Samaritan laws will protect the Samaritan from claims of
negligence and from liability for damages if an error is made by
the Samaritan while helping the injured person.
- The Good Samaritan law will protect the Samaritan only if (i)
the first aid or medical assistance is provided at the place or
scene of emergency/accident (ii) the Samaritan should not have a
motive of being paid a fee or a reward.
