trademark protects. Survey the subject matter that would receive trademark protection in your

hypothetical restaurant business.

Patent Protection

: Explain what types of inventions are patent eligible. In your business,

explain whether you would have any items that would have patent protection. You may also

comment on whether you need to apply for a patent. Feel free to use your imagination in

thinking about potential inventions that may be applicable in a restaurant.

Copyright Protection

: Generally, list the types of works that may receive copyright protection.

to do new restaurant business person needs to be careful about its intellectual property because sometimes the inventions of the entrepreneur can be infringened to breached if he doen not make a plan to protect it.the plan should include followin points-

trademark protection-

trademark protection in restaurant industry is the protection to name, logo menu items and in some cases, food designs—all these things can be protected by trademark law.

patent protection-

patent is the protection for a limited period of time to the invention of the person.in this patent protection should be given to materials include machines, manufactured articles, industrial processes, and chemical compositions

potential invention in my business for patent inventions are-

method for making molten lava cake.

composition & ingridients to make the new style fish & chips.

Copyright Protection-

list of works under copyright protection are-

Menu designs, marketing materials, and a restaurant’s website fall under copyright law.

formula of combination of receipies, wesites for my hotel, contents of the blog for my restuarants etc are some under copyright protection.

Trade Secret Protection-

the trade secret is any information used in a business that gives the owner an economic advantage over competitors who do not know or use the information.

Trade-secret information can “include a formula, pattern, compilation, program, device, method, technique or process.

  • vendor lists,
  • specific ways of doing things in the kitchen etc.

Distinguish between the types of protections-

each protection is important in its own ways like

  • trademark prevent the name & logo of company from stealing by others
  • patent provide limites protections to inventions
  • copyright protection provide protection to the inventions from mind works.
  • trade secret provide protection to protect secrets of the business to competitors.

.according to me, trademark & copyright protection are most important to my bussiness as in my restaurants most of the things like dishes, processes, use & combination of ingridients etc are the results of my mind or creation of my mind.

Infringement Concerns-

to start a business i would look that my creations & name logo is uniques & not other competitors have the same things or nearly same things as me.because i do not want to infringe the rights of others.

steps to avoid the problem-

  • always seek for information before any copyrighting or patent of the work.
  • ensuring that trademark is available.
  • learn from the mistakes of others
  • avoid confusion
  • resgistration of everything etc.

Relevance and Significance of Intellectual Property-

yes, this important to understand these protections before starting business because if do not do that then you would face many problems in the start of your business like legal suits, titles like copycat, or your work inventions may get benefits to others more than you if do not protect them.
