When a campaign is underway in a Company to try to unionize the workers discuss what things management may legally do to try to discourage the workers from voting for a union, and discuss what things union organizers may legally do to try to encourage workers to vote for a union. Also discuss whether in your opinion the pendulum has swung too far in favor of management or labor with respect to the things management and labor may legally do to try to influence the workers’ vote on whether or not to have a union.

Answer: There are a number of things that an employer may legally do to prevent employees from unionising

  1. They should talk to the employees and convince them for not joining the union by highlighting the negative points about the unions
  2. Create policies that are as per the expectations of the employees
  3. Explain them the new obligations that they may face if they join union
  4. Take disciplinary action against the employee who is forcing or threatening the other employees for joining union

The organizers can legally do the following to encourage the workers to join union

  1. Contact the workers after working hours and talk with them about the need for joining a union
  2. Distribute literature related to the Union
  3. Ask the workers to sign the membership cards
  4. Tell the workers to talk with the company and express their willingness to form a union

No I don’t think that the pendulum has swung too far in favor of either management or the union. Both the parties have a fair chance to do things legally for influencing the employees to either vote in favor or against joining the union
