Alex the Builder, used Joe’s elbow joints on a job in Westport. Alex’s employee, Mark, was testing the plumbing by turning on the hot water full blast. The joint broke and a part of it lodged in Mark’s eye. In addition, his face was scalded by the hot water. The entire first floor of the newly built house had water damage because several other of Joe’s elbow joints failed.
Explain how Mark’s can seek damages from Alex and Joe.
Based on the above scenario as Joe elbow points are used and Mark was testing the plumbing material by turning the hot water, unfortunately the hot water blasted and the parts that are used for testing broken and the broken parts are went to Mark's eye and he completely injured by the hot liquid and steam that comes out from the water. Because of this incident the first floor and there is completely damage of water system in the floor. In Fact Joe is also infected by the accident that occurs in the building and his elbow joints failed.
LABOUR COMPENSATION FOR DAMAGES:
Here Mark is the most affected in the accident he should be covered for all damages that occurred in the accident. Any person who is managing the works as a representative of the works that are carried out for that building are Alex should compensate for both Mark and Joe who are affected in the accident.
