INTRODUCTION:
Trademark is an intellectual property like design, logo, sign etc. It helps define a company's brand.Trademark registration is not mandatory. However, registration of a trademark helps in protecting its ownership, preventing imitations and misuse, creating a branding in the market etc.A strong trademark is typical an original one, unique, distinctive, attractive, not close to any other available trademark. Example of a strong trademark is Apple's logo. It is a unique trademark in the sense that an apple's image is being used for technology products, which defies general industry norms of using a logo related to the product.
Current state of international protections of trademarks;
Currently trademark protection is governed by the Madrid Protocol. Its purpose is to streamline the process of applying for trademark protection in multiple countries by establishing a uniform process. The issue with the Madrid Protocol is that there is no enforcement requirement. Therefore, some signatories may not recognize the trademark. Regional efforts for uniform trademark law have been more successful. Madrid also allows trade mark rights in more than one jurisdiction to be licensed, licensed and maintained, provided the target jurisdiction is a party to the scheme.
