Angela and Bart are animal rights activists. Angela lived near a horse ranch owned by Chris. She told Bart that she suspected the horses were being abused because she saw people going in and out of the barn at all hours of the day and night, and suggested that they go there to investigate.

Unable to open the ranch gate, Angela and Bart climbed the fence, crossed the yard, opened the door to the barn, and stepped inside. There, they found healthy horses, but also a large amount of stolen electronic equipment.

Surprised to see intruders, Chris, who was carrying a rifle, pointed it at Angela and Bart and accidentally caused it to discharge. The bullet hit the side of the barn near Angela and Bart. The noise startled the horses. Angela and Bart fled, letting out the horses. A motorist, who was driving down the road, swerved to miss the stampeding horses, crashed into a tree, and died.

With what crimes, if any, can Angela reasonably be charged, and what defenses, if any, can she reasonably raise? Discuss.

Angela and Bart are animal rights activists. Angela suspected that the horses are not safe inside the ranch as people any time comes in and goes out of the barn. Due to this, they decided to investigate hence tried to open the ranch gate. But they unable to open the ranch gate hence, they climbed the fence, crossed the yard, opened the door to the barn, and stepped inside. They saw a large amount of stolen electronic equipment.

As they are intruders so Chris, who was carrying a rifle, pointed at Angela and Bart and accidentally caused it to discharge. The bullet hits the barn near by Angela and Bart due to which horses startled which causes the motorist accident.

Rule:

At common Law, burglary is a breaking and entering at nighttime, into the dwelling house of another, with the intent to commit a felony inside.

She might form an agreement to commit the crime with Bart as they both will be liable if crime happens. They both are animal right activists hence they both has to make the horses ran away when they saw that horses are not feeling safe. But they did not do this. This proves that they aim was different.

Homicide of the motorist was done by the defendant but it was actually cause by the Angel and Bart. Hence the charges of being indirect killing of a motorist was applied on both of them.

The Bart was agreed in the activity hence he is also included in the criminal proceeds.

The Chris was responsible for an intentional causing of an apprehension of an immediate harmful or offensive contact, or an attempted battery. Hence the charges are applied on him.

Application:

The facts which proves that the Angela and Bart was not responsible for the crime are:

  1. They were animal right activists.
  2. Angela suspected so they investigate on issues.
  3. They tried to save the horses so they make the horses to fled.
  4. They wanted to save their selves as well as the horses.

The facts which proves that the Chris was not responsible for the crime are:

  1. He safeguards his property or land area from intruders.
  2. His horses are healthy as found by Angela and Bart.

Conclusion:

Angela and Bart are the animal right activist hence they use to investigate the cases which are suspicion. Hence, they entered in to the ranch but they found that the Chris having the gun in hand so they might be afraid and because of this, they tried to release the horses. Hence, they are not responsible for the homicide as their intention was correct. They just want to save the horses. But the Chis was thief as there were theft electronic material were kept hence in order to undisclosed of his secrets he might have shoot on both but unfortunately the bullet was not on the target hence they both were escaped hence this causes that they release the horses which indirectly causes the death of the motorist.
