The Affordable Care Act (ACA) brought mandatory, subsidized healthcare to the U.S., but this is only one part of the ACA. The full name is “The Patient Protection and Affordable Care Act,” and it's the “Patient Protection” portion of the act that has arguably had the biggest impact on healthcare compliance.
Regulations by the government are meant to protect the public by providing programs to help improve health/welfare such as medicare and medicaid. Examples of oversight would include seeking out waste, abuse of the system and fraud in order to keep the health care system running smoothly, effectively, and ethically.
- A vision regarding the legislative changes was found by Vogenberg. Moreover, he also emphasizes instability and uncertainty as being the main effects of frequent changes.
- Despite efforts in Congress to repeal and replace the PPACA, no legislative changes have been enacted. The focus now turns to administrative branch (regulatory) action for commercial and public-sector insurance.
- Uncertainty surrounding the actions of the administration and Congress while progressive loosening and changing of federal rules will likely go on. This will accompany a variety of state-level changes and administrative practices that are evolving in response to the new administration’s regulatory strategy.
- P&T committees and other operating committees of the medical staff will need to keep abreast of what can or does happen at the federal, state, and local government levels. They should also examine generic and novel products that appear on the market as they consider cost-effective options for clients and patients. In addition, health care organizations and administrative bodies should monitor changing FDA regulations and policies that may impact their organizations.
