The distinction between shipment and destination contracts for the purpose of deciding who will bear the risk of loss should be eliminated in favor of a rule that always requires the buyer to obtain insurance for the goods being shipped.
Destination Contract: Under Destination Contract, Goods are the property of the seller until they are delivered to the buyer. Once they make it to their destination intact, they become the property of the buyer.
Shipment Contract: Undre Shipment Contract, Goods are the property of the seller until they are delivered to the shipping company. Once they make it to the shipper, they become the property of the buyer. The buyer would have to buy insurance to protect their goods in transit.
