Solution : This legal test is known as The Common Law Control test. In this test, The employer has the right to control and dirst his employee. He directs the employees about what work to do and how to do it. If an employee is obliged and follows the orders of his Boss, he is an employee. If the Boss is controlling most of the tasks performed by the worker, the worker is an employee. If the worker is controlling and carrying out most of the tasks independently without the instructions amd approval of the Boss, he is an independent contractor and not the employee.
