Discuss your findings of the Conditions of Participation (COP) from the Code of Federal Register (CFR) as it relates to the various life safety code or fire codes for various healthcare organizations. The attachment contains several life safety rules that administrators of nursing homes and facility directors for all types of healthcare need to be explicitly aware of, as their organization will be inspected annually by the State Fire Marshal.
The CFR's state that organizations have to follow all the rules found in the National Fire Protection Agency (FNPA) 2012 rulebook, but in the attachment, you will see the rules that are the foundation of safety management for healthcare organizations.
To help frame your discussion, please share the regulations you found for at least three aspects of a health care operation, such as dietary, medical gas, healthcare occupancy, and physical environment. The centers for medicaid services issued a proposed rule of requirements from federal register is referred as conditions of participation (COP). In which the hospitals must meet certain requirements to participate in medicare and medicaid programmes.
Medicaid provider compliance with national fire protection association (NFPA) with 101 life safety code (LSC) and (NFPA) 77 health care facilities code (HCFC). The LSC is a set of fire protection requirements designed to provide a reasonable degree of safety from fire. it covers construction, protection and operational features designed to provide safety from fire, smoke and panic. The HSFC provides requirement for installation, inspection, testing, maintainence, material equipment and appliances.
The Basic life safety from fire requirement for facilities participating in medicare is compliance with 2012 edition of NFPA, LSC & HCFC. CMS partners with state agencies to assess facilities for compliance with LSC requirement. SAS may enter into sub aggrement on contract with state fire marshal officer. under these agreements the designated state fire authority generally agrees to:
1. Survey non accredited hospitals, hospices in accordance with schedules the SA furnishes.
2. Survey accredited hospitals selected for validation surveys or surveyed as a result of a substantial allegation of an unsafe conditions.
3. Complete the appropriate fire safety survey report
4. Prepare statements of deficiencies and review plans of correction.
5. Make recommendations to the SA regarding facilities compliance with programme fire safety requirements
6. Use only qualified fire safety inspectors who have received CMS training in the performance of these surveys
