The Fourth Amendment provides protection against unreasonable searches and seizures. What would constitute a reasonable search by the police
The Forth Amendment of the U.S. Constitutions provides the right of the people to be secure in their persons, houses, papers,and effects, against unreasonable seaarches and seizures shall not be violated, and mo warrants shall issue, by oath or affirmation. The ultimate goal of fourth amendment is to protect peoples right to privacy and freedom from unreasonable institution by the government. In general most warrantless searches of private premises are prohibited under the forth amendment unless specific exceptions are not allowed.
The court must determine what constitutes a search or seizure under the fourth amendment. a search occurs when a governmental employees of the government violates individual reasonable expectations of privacy.
A seizure of a person within the meaning of the amendment occurs when the polices conduct would communicate to a resonable person taking into account all the circumstances surrounding the encounter, that the persons is not free to ignore the police presence and leave at his will.
