Issue: in a case of involving escape from federal custody did the district court err by disallowing consideration of defendants asserted defence of evidence of druess and necessity which was in the form of of various conditions and events at the federal jail ? Conclusion: according to the supreme court of the United States the trival court was correct in demanding that respondent prisioners show some evidence that they attempted to Surender or engaged in equivalent conduct once they had freed themselves from the conditions they described .when respondents failed to provide such evidence the trial court correctly ruled that respondents had failed as a matter of law to present evidence sufficient to support the defences of necessity or duress because they had not turned themselves in after they had escaped the allegedly coercive conditions .the court reversed the judgement of the court of appeals
