You have sought advice from a tax agent who has failed to correctly provide you with advice. You have had to pay penalties as a consequence and have made a complaint to the TPB. What options are available to the TPB when responding to your complaint about the agent? Conduct independent research as needed. 150–180 words

AND THIS IS NOT THE ANSWER!

Below options are available to the TPB after the complaint is filled by the applicant and the board has suitable grounds to justify that the return was not filled as per the law.

The board may deny the renewal of license of the agent.

The board may terminate the tax agent.

They may intimate the agent for the breach of code of conduct..but the board may not be able to act in the below cases

Penalties that are imposed by the Tax authorities.

TAX PRACTITIONERS BOARD

Before you make a complaint to TBP about a tax practitioner, you should try to resolve the issues directly with the concerned practitioner initially.The issue you have may be put into words and provided in writing to him,attatching all relevant details you have found out. This written copy can be shown as a reference when the TBP asks to submit details about the steps initiated inorder to resolve the issue.

In order to provide the basic facts of the case, an independent research needed to be done so as to bring the facts of the case into light

  • find out the exact reason for being penalised such as getting a refund that you're not entitled to receive, showing incorrect figure on the financial statements etc.
  • collecting proof for the above mentioned, such as attaching the required part of the books along with the complaint.
  • Making/showing a statement of declaration that it was unintentional and without your knowledge. (that is,you were not aware of this default in the statement)
  • preparing an amended statement with the help of a highly qualified/rated professional and cross-checking it with two other such professionals.
  • attaching copies of payment made to the tax practitioner involved in the issue as a proof that it was actually he who have rendered the service. (in case he tries to deny it)
  • statements that the service provider have not compensated the customer to negotiate forgiveness of the error or a reduction in the penalties.

If it discovers of any intentional wrongdoing, it could rescind the individual agent's tax identification number. Licensed service providers may also face action from their state's regulatory body.
