Would the Canadian Charter of Rights and Freedoms prohibit an employer from putting in place a selection system that favored women over men in the hiring process? Could such discrimination ever be justified under the Charter?

Expert Solution

The Canadian charter of rights and freedom is one part of the Canadian Constitution; The Constitution consists of rules and regulations for how to operate the country. Every country is having its own constitution. Canadian constitution contains the law for federal as well as provincial governments.

The charter of right and freedom is the bill of right enacted in the constitution of Canada on April 17, 1982, and signed by Queen Elizabeth II Canada; It is having a federal status, that means it can be amended by legislative law. The charter contains law that freedom a democratic society requires like freedom of speech, the right to live and seek employment anywhere in Canada,

The charter safeguards the employment, it removes discrimination against men and women and it implies the woman has the right to equal wages as its counterpart means men.

The charter right and freedom are not absolute; it can be changed taking the interest of the country, like freedom of expression does not allow freedom of delivering hate speeches.

In employment, the discrimination of hiring a woman candidate over a man candidate should not be allowed. As it will be discrimination with a man, as the charter provides equal rights. Means a right candidate whether a man or a woman should be hired without discrimination.
