◾How would the system decide who would go to a juvenile delinquency court and who would go to a status offender court? Explain. ◾Specifically, what would be the advantages? What would be the disadvantages? ◾Do the advantages outweigh the disadvantages? Why or why not?
The status offender is a term for a juvenile who has committed an act that is an offense only because of the age of the juvenile. If they were an adult there would be no offense. Juvenile offenders are juveniles who commit offenses that are violations of the law at any age (Bartollas, 2008). For example; typical status offenses include truancy, running away from home, violating curfew, underage use of alcohol, and general ungovernability. Criminal acts of juveniles that will be considered crime at any age such as theft, murder should be juvenile delinquency. The advantages include the fact that punishing offenders based on the severity of their crime i.e. either through the Status offender court and juvenile delinquency court would act as a deterrent. However, the cons of such a punishment are that it may lead to the development of a criminal bent of mind due to exposure.
