How and why is providing treatment to restore competency to stand trial ethically complicated for mental health professionals?
According to law a person suffering from any mental health problem cannot be charged or any trail will take place . Perhaps he must be recovered and he should be perfectly alright to know what is going to happen with him . But if he is lunatic since the time he was born than no charges will be registered against him because what ever he had done was not performed under his senses .
But if he had committed a crime and than he becomes a lunatic than court will ask the experts to treat him by taking to him to mental health professional so he can be punished . And my opinion that is correct , though he is not stable but he had committed a crime which is against a law and he performed it when he was stable.
Mental health professionals face problems when the treat a patient to restore competency .
Political connections ,when the doctors are handling a high profile cases they can be pressurized politically .
Some times a offender is innocent ,a person has a charge of a murder but he continue to deny that he has not done and later he gets mentally unstable soon after that ,he is sent for treatment and there also he deny the charges but doctors do their work and it put them in a dilemma, but later it is proved that he is innocent .
Death threat from families of offender .
There are many problems which they face ,and these are some examples .
