According to various jurisdictions, assault is defined as the threat of bodily harm which leads to fear to the victim while the battery, on the other hand, is defined as actual physical harm to an individual. In other words, when an individual has only been threatened and barely touched that is regarded as assault while the physical impact on a person is regarded as a battery. Nonetheless, Assault and battery can be grouped as similar crimes and offenses as they both intent to cause harm to another person. also, both assault and battery involve contact with another person without their consent and both can lead to lawsuits. The punishment of both crimes is depended on the level of the assault or battery and with the levels of battery and assault being grouped as first degree, second-degree f third-degree assault or battery with every degree of crime determining the severity of the punishment.

Vicarious liability refers to a principle in the modern tort law and which holds one liable for the actions of another person when involved in collective or joint activities. It arises when one is entrusted with the performance of certain tasks on the behalf of another person. some situations which one can lead to vicarious liability include;

  • contractors being liable if their subcontractors fail to complete tasks or perform tasks in the wrong manner
  • parents can be liable if the actions of their children cause harm or damage
  • employees may be liable if they act against the policies set by the employer
