East Coast Waffles, Inc., an Atlanta-based company which owns and operates more than 100 Waffle House restaurants in Florida and Virginia, fired an employee who claimed that his fellow servers at a Tampa Florida Waffle House were harassing several customers because of their race. The employee that was fired did not claim "whistleblower" status, the employee simply claimed that such action was improper. East Coast Waffles, Inc., an Atlanta based company which owns and operates more than 100 Waffle House restaurants in Florida and Virginia, fired one of their employee, who claimed harrasment of customers by one of their fellow servers because of their race, which violates, Title VII of the 1964 Civil Rights Act. This act prohibits employment discrimination based on the race, color, religion, sex and national origin.
The Equal Employment Opportunity Commission agency settled the retialiation for complaining about racial harrasment from the third parties such as customers. They settled this case through their conciliation process which includes the pre-litigation settlements. According to the terms of the parties aggrement, East Coast Waffles will have to pay $25 thousand to the terminated employee and in order to prevent such situations in the future, proper training to the staff is required which include managers and HR personnels.
Whistleblower:
A whistleblower is a person who exposes secretive information or activity which is deemed to be illegal, unethical or incorrect within a private or public organization. The whistleblower protection act 1989 was enacted, to protect federal employees who disclosed Government's illegality, waste and corruption. The whistleblower has a right to disclose confidential information which he reasonably believes to be an evidence. It may include the followings:-
1. Violation: Any law, rule or regulation being violated.
2. Wastage: A gross wastage of funds.
3. Any misuse of authority or gross mismanagement.
4. Public health: It includes substantial and specific danger to public health.
5. Public safety: It includes substantial and specific danger to public safety.

1. Robert E. Weisberg- A regional attorney for the Equal Employee Opportunity Commision's (EEOC), Miami district office said: "We commend East Coast Waffles for working cooperatively with EEOC to quickly resolve this matter, without need for costly litigation".

Malcolm Medley- Director of the EEOC's, Miami district office said: "The fear of retialiation can prevent employees from raising legitimate concerns with their employer, even when a company has a hotline or some another mechanism for voicing discrimination or harrasment complaints. All employers should carefully examine their own policies and practises to ensure compliance with civil rights law".
It is a responsibility of EEOC's for enforcing federal laws against employment discrimination.
