Consideration of arrest records is almaost certainly unlawful.An arrest is no indication of whatsoever of guilt,and historically minorities have suffered proportionately more arrest than others.An arrest is merely the detaining of a person to answer a crime and no affect on fitness to perform a perticular job..
On the other hand an employer probably has the right to exclude persons who have been convicted od certain offences from certain consideration for certain kinds of jobs.To avoid frightening off qualified applicants who who have irrelevent criminal records ,the best practice would be to obtain conviction information through local police departments rather than from applicants.'Have you ever been committed of a crime?'is lawful question,information obtained must be used only if it relates to applicant's fitness to platform a perticular job.example;person convicted for embezzlement would be high risk for position as cashier in a store.
