Uncle Ned overhears you talking about the course and says he always wanted to be a juvenile court lawyer but never knew much about how juvenile courts are organized, what type of cases they consider and the philosophy of the juvenile justice system. He is also curious about the differences between adult court and juvenile court. Please answer each of his questions.
When we talk about the juvenile court system, the court mainly deals with the cases related to the minors who are accused of committing any crime or breaching any criminal law. In comparison to the adult courts, the proceeding in this court is of civil nature rather than criminal. So rather than being chared to be the part of a crime, the main acquisition of juvenile offenders is done for the delinquent act.
Philosophy= The main concept of juvenile court system was to develop a new concept related to the children having new strategies and policies to implement social regulation or control in rider to come up with a judicial welfare option within the criminal justice system so that the children can be removed or taken out from the judicial process made for the adults, to implement the new and latest philosophy of dependency of children and to replace the state in the form of parens patriae.
Differences between adult court and juvenile court=
The trail in the adult court is done under the jury while the judge takes care of the juvenile cases.
The punishment of adult court is quite serious and hard than the juvenile courts and despite having the strict punishment, juvenile courts do not grant strict imprisonment
It is quite difficult to expunge the crime committed by the adults but in the case of juvenile, it is possible to seal the records.
