CONSUMER GUARANTEES – Schedule 2 of the Competition and Consumer Act 2010 (Cth) (“the ACL”)
Explain the rule that goods must be reasonably fit for any disclosed purpose.
Can the consumer guarantees be excluded under the ACL?
Under the consumer guarantee provided by the manufactur or supplier as per the Australian Consumer Law, the goods when sold to the consumer hold some guarantees. One of these guarantees state that the goods must be reasonably fit for any disclosed purpose which means that the product should be working in an absolute condition according to the function it has been made for and mentioned by the supplier or manufacturer and also disclosed by the consumer.
Consumer guarantees are the certain basic set of guarantees provided by the manufacturers and suppliers to the customers at the time of purchasing the goods and services from them. These guarantees are provided regardless of any warranties provided by the supplier or manufacturer in their internal policies or even after the expiry of such warranties. These guarantees cannot be excluded under any conditions. Nor can any such contract has effect that limits the cusomer right to such guarantee.
