GHG Bellfast, a shipyard company, employed a female welder. She was harassed by certain male employees. The men drew obscene graffiti directed at the victim all over the plant. They also made numerous suggestive and offensive remarks to the victim concerning her body. The victim complained about this atmosphere of harassment. The company’s supervisory personnel immediately transferred those male employees to another department with a warning. A few days later, she sued the company for creating a hostile working environment. Does GHG Bellfast have any defense against the charges?

Expert Solution

If we consider the legal grounds for her lawsuit, we will notice that the fact that she would sue the company even after the company had taken necessary actions against the employees regarding her complaint is invalid. This is due tot he fact that even though it is the responsibility og tyhe company to provide a safe woprking environment to all its employees backfired, they had taken all the necessary actions in the view of her complkaint. The situation was appropriately dealt with. therefore, to save themselves from the charges the company can use their actions as the legal ground to turn the suyit down and the motivation behind her actions could be considered unethical. Harassment is a serious offence, and the company had shown that they take all the necessary actions when faced with any situations that demand such authority and decision making power. Applying the case for the given reasons would not be sufficient to essentially bring charges against the company and they can, therefore, put up their defence in this form properly.
