Summary of the existing facts McDonald's: The Coffee Spill Heard 'Round the World
McDonald's which started in Illinois, present over 100 countries came under a lawsuit because of its coffee spill causing burns. According to the customer, the temperature of the coffee was too high at 170 degrees, with chances of getting secondary burns at 3.5 seconds. Even though it received 700 complaints it did not lower the temperature of the coffee. It was told to take action on three characteristics namely, temperature, design and customer safety. It was argued that company should maintain good social responsibility. It did mention a warning 'Caution: Contents Hot' but it was in small print. McDonalds blamed liebeck for being negligent. It was reasoned that the company should at least tighten the lid to prevent it from falling and increase the quality of the coffee cup. McDonalds refused to pay citing that the customer should be careful and reasoned that hot coffee is supposed to be sold at that temperature.
