The restaurant is liable in a number of ways to a customer. The first liablity is of premises, where the owner is liable to ensure the safety, security and well being of the visitors and keep the premises in best condition that facilitates this goal. Another liability is strict liability of the food items served by it for their fitness for consumption, safety for customer's well being and having reasonable standards of quality of items that meet the expectations of customers. A restaurant's failure to inspect and check bugs, rodents and small insects can not only affect the hygiene level of place, make the items prepared by the restaurant unfit for consumption, but also result in serious, life threatening illnesses cause by the pathogens carried by them, and can cause serious breach of contract for ensuring health and safety of customers. The pets kept by the owners at property or the presence of stray animals can also affect the well being of customers through injuries, bites or psychological trauma through attack.
The restaurant can avoid the premises liability by keeping it free from domestic as well as stray animals or keeping them at reasonable distance from the visitors to avoid any chances of contact. The product liability can be avoided by inspection of incoming products for small insects, keeping the proerty sanitised by taking professional help to remove rodents, lizards and insects and ensuring hygiene and cleanliness, establish safe work practice to keep the bugs and parasites at bay and also wokring at supplier end to keep the incoming products free from them.
