Process looks like below:

  1. With an examination of Joint Committe, an unpaid claim can arise refund or credit. The examiner decides whether a case falls under Joint Committee jurisdiction or not. The return or examination reported to JCT may not alter the nature of the examination.
  2. Juridictional amount to process case with JC for C Corporations is in excess of $5 million and for all other taxpayers the jurisdictional amount is in excess of $2 million.

  3. A Joint Committee Specialist reviews the case files for procedural, calculations and accuracy and will prepare the report that is submitted to the JCT refund staff for review by the examiner.

  4. The JCT staff attorneys will review the Joint Committee report and other documentation. If they have any queries, Usually resolved informally through phone calls or e-mails to the JCR. When JCR came to know that the staff attorney has no further questions, the case can be processed. In the event the JCT disagrees with answers then it will not processed pending the resolution of the dispute. "JCT will issue either a clearance letter or Staff Review Memorandum (SRM) upon completion of their review."
