Vladko was hungry, so he drove down to the local Pay’n’Stuff restaurant to get something to eat. He drove up to the drive-through window and said to the cashier “I’m really hungry. What would you suggest?” The cashier told him that the special of the day was the Triple Burger Hungry Man Meal that came with a side order of potato wedges and a large soda drink. Because he was really hungry, Vladko ordered two specials, paid the price and drove home. A few hours after finishing his two meals, he felt extreme stomach pain. He rushed to the hospital, and the doctor examined him thoroughly. The test results indicated that Vladko had developed food poisoning, which could be traced back to the potato wedges. Vladko sued Pay’n’Stuff under the provisions of the Sale of Goods Act.
