Health is very important and very basic need for human flourishing and Health care is a fundamental human right. Healthcare can promotes and sustains human health without distinction of race, religion, economic and social conditions.Now in these days, healthcare system main goal is to provide all necessary healthcare services to those people are in need but it is not equally provide right to all people due to the different reasons like costs, medical sources, technology.
-States obligation to support the right to health is providing maximum available resources to provide quality of health care to people through different systems and polices like health insurance which are adopted as health care law by government.
The limits to the right to healthcare: There are two important factors are taken into account to careate the limits to the right to health care. they are recognizing the right to healthcare is the recohnizing the limits on entitelments that result from resource scarcity and competing the use of those resources. It means to recognize the need for further monitoring of health access issues by medical community and for a great deal of more research into the effects of stateless individuals to access to healthcare.
the right to healthcare includes System relative entitlements : While recognizing its importance , arrived at a resonable, incomplete, and imperfect way of restricting its scope. it means it does not give individuals a basic right to have all of the patients needs met. Due to this some social obligations has degined a healthcare system that protects opportunity through an appropriate healthcare services like insurances.
To give right to healthcare on the maintenance of normal functioning of patients health, a clear gap is between the uses of medical technologies that count as legitamate Treatments and those needs do not meet Healthcare needs.
The healthcare insurances always meet with the needs of patients who are severly injured, accidents, severe disease conditions like heart attacks, surgeries, organ transplant.
The healthcare insurances does not meet all healthcare needs like treatments for appearances like cosmotic surgeries,plastic surgeries etc,,Abortion is not therapeutic treatment because it does not covered by heathcare insurances in some countries.
The costs of some cases like vitro fertilization are high and effectiveness is modest. Hard cases invlolves non reproductive technologies which are not covere by insurance. Even in the United states, many insurances can cover growth hormone treatment only for children deficient in growth hormone, not for those persons who are equally short without pathology.
Answer to 2nd question:
Rationing is allocation of scarce resources in healthcare to provide the quality of care and treatment within their source.Rationing is unavoidable beause patients needs are limitless and technology and medical resources are not.
-Physicians must take difficult choices to allocate finite resources to achieve reasonable balance across social goods like public safety, education and defense. For example, Physicians in ICUs should rationale their time because they must decide which patient to see first and how much time to spend with each.It is fact that physicians cannot provide every potential benefit treatment to every critically ill patient.
Under some circumstances rationing does not happen when healthcare costs are effective like choosing low cost treatment over more expensive treatment but still it provides all effective treatment. in this type cases, rationing is avoidable.
Answer to 3rd question: healthcare system means the organizations established to meet the health requirements of patients.
the requirements for a healthcare system that is morally justifiable are :
-A financial support mechanism,
-a well trained and adequate treatment to patients provided by experienced phisicians and
-well paid and sufficient workforce, reliable information on which base decisions to give treatment and policies must taken,
-Well maintained health facilities to deliver qualiy of medicines and treatment to patients and provide adequate technolohies.
