In a criminal lawsuit, what is the special name for the plaintiff? Who does this person represent? What must this person do to obtain a conviction of the defendant? In a crime where there is a victim, what role does the victim play in the lawsuit? What might the victim hope to gain? How is this different from the role of the injured party in a civil lawsuit?

Solutions

Expert Solution

the special name for the plaintiff in criminal lawsuit is "complainant".

this person is the one who raises the complaint.

compainant raises the complaint againt the person who did the crime, the defender. then police will investigate, magistrate will inquire it and court will do the trial, afterwards judgement will come. in whole process, complainant should accompany with whole procedure to convict the defendant with right evidences.

victim can be the same person as the complainant or other person who is suffered in that crime. complainant may be the person who saw the crime and raises the complaint. victim has to be act as the proof to prove the case against the defender.

victim hopes to get justice, that is the suitable punishment to the defender in the case.

victims are the persons who all are suffered because of the crime. but injured party is the one who exactly met with the crime.
