Abood vs. Detroit Board of Education law can be seen as one of the major US labor law case in which the Supreme Court of the USA decided that the union shop in the public workplace is legal and cannot be stopped. The court decided that the union shop that was legal in the private sector is also legal in the public sector. the court stated that the non-members can determine the agency fees in order to recover the different types of related to the management of contract administration, collective bargaining, and grievance handling but these findings cannot be used for any sort of political objectives. So in my opinion, the public sector employees should also be given the chance to be represented by the union in order to have better collective bargaining.
The main effect of upholding the decision will be that it will provide the opportunity to the public sector employees to participate and form the Union and these union can charge the membership fee form the members and this will have better collective bargaining of these public sector employes.
