One of the most talked legal case of the fundamental right of abortion in 1973 is the Roe v. Wade. All state laws prohibited for abortion unless its risks the women health. The court has argued that the abortion is the fundamental right to women. Women have rights to have privacy in deciding of matters related to her body. But the supposition and opposition arise regarding the mother's privacy and the fetus. Ethical issues arise to safeguard the unborn child and also to protect the women privacy. Later, the ban for abortion is approved only the third trimester and changed the abortion regulation in the first and second trimester of pregnancy.

Another legal case of parenthood of Pennsylvania v. Casey enacted the abortion control Act. It emphasizes women has to take a decision before viability. It aims to reduce the undue burden on women due to abortion. This case was held in 1992 and again abortion regulation of informed consent at least prior to 24hours and women has to notify the husband had been initiated. It rejected the Roe trimester framework. The ethical issue arises regarding reproductive rights of women and outcomes of case restricts the rights of abortion laws of Roe v.wade.
