REPRESENTATION
Description -
When a person does not has a legal lawyer to represent or put
forward his or her case in court one can agrue on one's behalf (
litigant in person)
Bad idea , due to
- Lack of knowledge and experience , in 2011, a survey recorded
that in Federal Judicial Conference stated that 37% pro se had
problems in examining the witnesses and even 53% found that the
representing party tend to take advantage of pro se
- They have lower chances of success , already and accused and
has no lawyer to represent him ,. Moreover with no such knowledge
he is carrying legal proceedings
- Specially, coming to criminals there is PRISON LITIGATION
REFORM ACT ,to which American CIVIL LIBERTIES UNION ,has said that
the former act has denied access to courts for the prisoners who
themselves has been part of abuse and there should be check on
prisoner abuse also. And CONNECTICUT SUPREME COURT ,is also ready
to ask such defendants who are mentally ill where competency
standards will also differ
