While on routine patrol for the Anytown Police Department, you notice a group of what appears to be three underage male teens and one female teen standing along the outside wall of a local convenience store in a poorly lit area. Because it is 1 a.m. in the morning on a Thursday night, which is in violation of your city ordinance regarding curfew, you decide to investigate. When you turn into the driveway of the convenience store, your patrol car headlights illuminate the group of four teens—you notice a cigarette in the hand of the lone female of the group and it appears to you that two of the males are holding beer cans. After asking for identification, you began your investigation and realize that several decisions will have to be made regarding the underage youths. Introduction
Collectively over time, thousands of youth have enter or are in jeopardy of entering the delinquency and criminal justice systems because of their noncriminal misbehaviors. These misconducts are frequently referred to as “status offenses.” A status offense is conduct by a minor that is consider unlawful due to the age of the individual that is involved. In other words, an adult may legally engage in the same acts that are considered status offenses if performed by a minor. Shared examples of status offenses include running away from home, absent out of school without a valid reason over an extended period of time, alleged out-of-control or incorrigible behavior, underage alcohol possession, and curfew violations .
In the town of Havana, I was on my normal route when I encounters what seem to be three males and one female that are underage and hanging out at the local convenience store. The area the teenagers are in is very poorly lit area and it is past the curfew set for individual under the age eighteen. As my patrol car headlights illuminated the area I noticed that the female teenager had a cigarette and two of the three male teenagers were holding a beer can. After exiting the vehicle, I ask for identification confirm my suspicion before further questioning and to determine the next course of action that needed to be taken.
In a list you make in your report specifically identify the status offense laws that are being violated by each of the underage teenage violators.
In the above scenario all four underage teenagers are in violation city curfew. However, the two male teenagers that had the beer can in their hand are in violation status offense which deal with underage possession and consumption of alcohol and the female teenager is in violation of status offenses that deal with underage possession and use of tobacco.
Identify how you are going to process at the scene each of the underage teenage kid violators, then explain in detail why you made your decision to handle the status offense in that specific manner.
I would take all four of the teenagers back to the department wait to be picked up by a parent or guardian I would then issue a warning to each them for the curfew violation pending the pickup by parent of guardian. However, underage drinking rate among youth are considerably high but research suggests that the enforcement rate for underage drinking is quite low With that in mind, I would recommend a $500 fine on both teenagers that had the alcoholic drink, recommend enrollment in alcohol education programs and 40 hours of community service. Because, underage drinking is associated with vandalism and acquaintance rape just to a few offenses As for the teenager that was smoking a cigarette would recommend a $100 fine since this was the first violation, and up to 20 hours of community service .
Describe how you would handle any of the teenage status offense violators who is being uncooperative at the scene. How would this affect your decision on how to handle this status offense case?
If I had an uncooperative youth I would first separate him or her form the group by placing them in the portal car and call for back up to transport the others to the department for further questions. I do think that a juvenile’s behavior and attitude make a difference in law enforcement use of discretion. A juvenile who is well-mannered and polite is more probable to make off with a reprimand, whereas an aggressive behavior undoubtedly going to lead to a court referral. Welfare of the juvenile is the principle on which all juvenile systems are based .
If you have one or more uncooperative parent who refuses to come to the scene and pick up their child would this affect your decision on how you handle the case, and if so what would you then do with the child?
If I have a uncooperative parent that refused to come and pick up their teenager. I would recommend that the teenager be detained for a period of 24 hours until the juvenile court appearance. Then I would notify the parents once again of the hearing and are expected to appear .I would be more aggressive with pursuing more removing the child from the home because the universal belief in the courts is that a juvenile's wellbeing is protected best when the natural ties to their parents is well-maintained. However, where there is clear evidence that a juvenile is in danger, the state assumes legal guardian and this child.
Conclusions/Summary
In conclusion, the juvenile justice system is established to provide much need protect for youth. The status offenses are purely an expression of this responsibility to guard and assist our juveniles. Which at time protect the youthful actions that might results in truancy, runaways, alcohol use, and sexual behavior. For that reason, it becomes obvious that status offense laws are well regarded and it sole purpose is to guard, aid, and help minors that might enter the juvenile system.
