In 250 words explain the difference between testing someone honesty ( trapment), and entrapment, where the defendant asserts—as a defense—that he government invented the crime. Explain why the defendant’s predisposition (0r not) is her/ his best defense.
There is a difference between Trapment and Entrapment. Suppose a person is a known thief. He has commited so many crimes without leaving a single evidence against him. Now Police plans to use some bait techniques to catch him. Police has used baits like easy availability of drugs, a car with keys and a bag full of cash. All these arrangements have been done to catch him red handed. If such circumstances are taking place then this is known as Trap. This is a legal process.
Consider a second scenario. A person is innocent. Police is trying to catch a famous thief for a long time. Police is getting no success. So they plan to reduce their sufferings by some malafied practices. They simply catch that innocent person and try to pressurise him for accepting the crimes which he actually not performed. Then these circumstances may be considered as Entrapment.
Defendant's predisposition means that natural aptitude with which a person behaves in hard time. in such conditions a person act in a perticular way. He/she is sufferer of various deceptive activities and this causes his behaviour to come out in a particular and unique way.
When a person is traped that means he has commited the crime and police has sufficient proofs to disgrace him. When a person is entrapped then police may produce some fake eveidences. These evidences may seem to be so supportive in favour of police and seem to be against the person in catch.
In such case person's natural aptitude becomes his best partner. His predisposition is best method to support his innocency. His natural attitude gives him confidance to face various fake questions. This provide him firmness.
He says same thing 100 times. He remains far away from fabricating stories. All these becomes helpful in developing sense of confidence in senses of judge. His confidence and honesty gets reflected in his firmness and mental strength. All these work in his favour and in his support.
