Bob is driving down the street. He is not very attentive and crashes into the car...

Bob is driving down the street. He is not very attentive and crashes into the car in front of him, driven by Fred, a licensed blaster. Unknown to Bob, the car has dynamite in the trunk and explodes. The Fred is killed instantly. Jane is a pedestrian on the sidewalk next to the explosion. She is struck by flying chunks of the exploding car and seriously injured. The blast is so severe, that windows shatter as far a five blocks away. Ted is struck by falling glass from an office building five blocks from the explosion. Bob is uninjured. He is sued by Jane, Ted, and Fred's estate. How would he defend himself against these actions? Would his defenses likely be successful in any of the cases? Why or why not?

Following are the reasons/points in which Bob successfully defend himself against these case ;

  1. If Bob is not much attentive it means that maybe Fred car is not properly labelled with that it is "EXPLOSIVE MATERIAL CONTAIN IN VEHICLE" or a label of an explosive sign.
  2. Fred is a licensed blaster he knows how to store and pack this highly explosive thing. Maybe Fred quality of storing of dynamite is not in a proper manner.
  3. If Fred is carrying such type of highly explosive thing, he must follow the path in which there is less density of the population. Why he (Fred) is driving in the street raise the question.
  4. Bod is alive that's why he is sued by Jane, Ted and Fred's estate. Because Jane, Ted, and Fred's estate only know about hitting of Bod car into the Fred car they are the only eyewitness that's why they sued Bod.
  5. Jane and Ted are completely unknown behind the accident they only see the point of accident. Maybe Fred is not driving well too. And of course, they had suffered from injury and loss that's why he is sued by Jane and Ted.
  6. Maybe Fred's car is not in good condition, it is heated already and the momentum of Bob car provides an addition thrust which puts extra energy, by which dynamite explodes.
  7. Why Bob is alive?

Answer= He has a good quality built up a car like Jaguar, Mercedes etc.

These are some of the reasons by which Bob can defence himself in this case.

But also there are some reasons/points by which Bob can easily lose his defence, these reasons/points are followed;

  1. Maybe he is drunk and driving the car, due to the improper vision he can take the decision and got hit by Fred's car.
  2. Speeding of the vehicle.
  3. Doesn't obeys the traffic rules.
