Explain how a commercial can be deceptive or misleading but still not cross the line of illegally providing false information.

Solutions

Expert Solution

  • Companies make use of advertisements by providing information about the product, listing facts about the product, making some vague claims which cannot be approved or disapproved. There are certain claims or information given which may be deceptive, but they are not actually lies or illegally false since no one can disapprove this information nor can approve it.
  • For example,a company can claim their juice is the best juice anyone could have, but no one can prove it nor disapprove it to be false. This is just simple deception to sell the product.
  • But if the company mentions that they use ingredients in their juice which can help fight certain diseases, then this information can be scientifically tested. And if its not proven it will be considered illegally false. If they are persuading customers that by drinking their juice, they would be able to heart diseases, that it would be a false claim,as it can be scientifically proven.
  • Such claims become deceptive,by over exaggerating the statement to sell the product."It is the best juice in the world, nothing like it."Such exaggeration grabs the attention of the consumers and becomes successful in decieving them to buy the product. If the consumer considers it the best they will buy it.Such claims are subjective in nature and cannot be measured which makes them deceptive but not false.
