Sayeeda operated a small food stand at an open- air market where farmers in close proximity to one another had set up makeshift stalls or tables to dis- play their produce. To protect themselves from the hot sun, most had erected canvas or cloth canopies over their tables. The stand operated by Sayeeda was located in the midst of the covered stalls. For the purpose of cooking a particular delicacy that she sold, Sayeeda had placed a tiny propane- fuelled stove on her tabletop and used it to boil a pot of oil. While she was serving a customer, a youth about 16 years old turned up the flame on the burner, and the oil immediately caught fire. In a frantic attempt to put out the fire, Sayeeda seized the flaming pot and flung it from her food stand. The youth was splashed with flaming oil and was seriously burned when his clothes caught fire. The pot of burning oil landed in a nearby farmer’s stall and set fire to the canopy that he had placed over it. The farmer kicked the flaming pot out of his stall and into a neighbouring stall, where it set fire to a quantity of paper that was used for food packaging. Before the fire was finally extinguished, three stalls had been destroyed, and both the youth and Sayeeda hospitalized with serious burns. Discuss the rights and liabilities of the parties involved in this incident.
The Sayeeda case illustrates to provide the right-based perspective to explore the impact of the informal economy for fire safety strategy approach inorder to;
The evacuation procedures has to be strictly followed for fire strategy approach due uncontigencies;
The conflicts between formal and informal regulatory systems has to be minimised that exacerbate vulnarabilities, risks and exclusions of working poor. For Enabling Pro-Poor regulatory environment, the risks and conflicts has to be crucially adressed and understood for safe practices. The open flame cooking or unsafe stoves and fuele's being used by the Sayeeda has put constantly the lives of farmers stall to the utmost risk and burned as they lack information about danger in cooking this ways.
Selling food in open market is riskier due to the risk of burns,improper cooking, choking, allergic reactions and food poisoning. Also the Retail space wherein used may present the liability issues, they tend to collapse the customer as well. The Liability Insurance has to be bought for;
The Unforeseen events that may happen out of control is very difficulty to control when it comes to protecting human and physical as illustrated in this case very effctively which enacted difficulty for the business to recover from.Ensuring that precautionary measures has to be taken necessarily inorder to mitigate the risk by insuring the liabilities for the business that may encounter is very vital.
