What is meant by a “rule of capture”? Why is it efficient? Give three (3) examples, explaining which “rule of capture” applies in each case and whether or not it is efficient or not efficient in each case?
This law is given under uk or British law . According to this , the person or state that capture any natural resources first is owner of that resource, I.e.ownership of natural resources decided by this law.
I think it is efficient where conflict of interest between two parties is exist or prolonged and not reached to any conclusion . By using this law anyone who is first capture the resources is owner of that and thus conflict may resolve.
this gives an incentive for owners to drill on their land so as to extract the resources like groundwater, oil, or gas before their neighbors may capture , through wells.
Example:oil field capturing:in Pennsylvania
Advantage : extract of this resources possible and lead the way for development and fulfill the energy require.
Disadvantage:.it may lead to environment problem like capture and capture , and speedy use of resources and may lead to environment imbalance like pollution etc.
Water aquifer: fufill future need of water .but may also lead to develop new problem of speedy decrease of water table and may be clear way for human induce seismicity. For example Texas case related to this in which supreme Court prohibited the capture of water aquifer.
Example : south China Sea issue of resources use can be resolved by it may pave a way towards neocolonialism.
