Sid and Nancy were on a camping trip to Baxter Island. They had reservations on a ferry for themselves and their car. Because they had their two mountain bikes mounted upright and on a roof rack on their car, they had to use a special lane which was also designated for motor homes, vans, and other high profile vehicles. They were parked behind a motor home. During the crossing most drivers left their cars and went on deck. When the trip was over, Sid and Nancy wanted to leave but the driver of the motor home had not returned. One of the employees of the ferry motioned Sid and Nancy to turn to the left into the next lane rather than waiting for the motor home to move. Sid and Nancy followed the employee's hand signals, but unfortunately their bikes struck a low clearance pipe and the frames of both of their bikes were destroyed. Discuss the issues and the outcome of their lawsuit against the ferry company.

Solutions

Expert Solution

answer-

The facts in this case are Sid and Nancy had reservation on ferry company for themselves and their car.

Second fact, One of the employee advice Sid and Nancy to turn to left instead of calling the owner of motor home and ask him to move the motor home.

Sid and Nancy followed the signal of employee's hand

their bikes struck a low clearance pipe and the frames of both of their bikes were destroyed

In this case, the legal issue which could arise are-

Is Ferry company is responsible for the damage to Sid and Nancy?

so, In this matter i would say Yes, Ferry company is responsible for the damages because Under Respondeat superior legal doctrine the act of employee under the employment are considered act of Employer.

In this case, one of the employee of Ferry advice the left turn and lead to damage so it falls on Ferry company too.

second if low clearance pipe on the property of Ferry which cause also the damage so Ferry company is responsible to pay to Sid and Nancy.

so outcome will be in favor of Sid and Nancy
