Draft a law that would permit the use of polygraphs in criminal court cases under limited circumstances, needs to be 750 words or less.
Introduction- The polygraph test is used in criminal cases to find perpetrators and accuse. This test is being held by the permission of the court and depends on the Judge and Jury to allow or not. The use of polygraph test is a controversial issue so that we need to draw some circumstances to utilize the test.
1- Explain the reason of Polygraph: There must be confirmed statements to describe the reason in front of Jury and accuse. This test is important but not completely valid so that court needs a professional to use the test for accused and victims both.
2- Define the real findings of Polygraph: The person who wants to use the polygraph must define the complete and committed reason to use this test and state the previous finding which had been used to find the perpetrator.
3- Proper preparation: We need to prepare the person who is going to be tested through the polygraph, professional work during testing is necessary. As we know the polygraph test does not show the high reliability so that we cannot stick with the findings of this test.
4- Define the purpose of testing: defining the purpose of the test is most important, we must follow the ethics of medical and criminal testing and human rights during the test process. The test is based on some biological and medical aspects as well as psychological personality and behavior testing.
5- Analysis of Data must be confidential: The data record from test need to be confidential and based on the core purpose to find reality. The test does not explain the truth so that we cannot take the score as personal interest.
Conclusion- The polygraph testing is good during criminal cases, the finding depends on multiple factors, the purpose of testing is to, aware the Judges. The testing is an important factor to get the proper findings but not for sale the information or manipulate it.
