Situations when parties are avoiding the contract and overruling the rules of contracts that leads to the breach of contract. In a condition when any party or individuals to a contract, whether oral or written, fails to perform any of the contract’s terms, they may be found in breach of contract. While there are many ways to breach a contract, common failures include failure to deliver goods or services, failure to fully complete the job, failure to pay on time, or providing inferior goods or services.
An unjustifiable failure to perform the terms of a contract
A violation of contract through failure to perform, or through interference with the performance of the contractual obligations
Effectiveness condition of breach of contract-
(1) Repudiation of obligations before the beginning of the contract.
(2) Repudiation of obligations before its completion.
(3) A conduct that prevents the contract's proper performance.
