When dealing with a representative in negotiation, how do you
know whether he or she has the authority to bind the other party?
How do you ensure this?
ANSWER
When we deal with a representative in a negotiation then it is very important for us to bind the other party in a contract. Basically in a contract there are two parties, and representative can represent any of the party. When any of the party does not have enough time to deal with all the formalities of the contract then they assign any representative for the formalities of the contract. In other words we can say that representative plays very important role from the side of other party. So it is very important for us in negotiation to bind the other party in the contract. For that we should fairly deal with the teams and conditions of the contract. It is very important for us to ensure that other party is bind with the contact. For that purpose both the parties should follow the rules and regulations of the contract. Each and every conditions of the contract should be clear between both the parties. All the parameters related to the time period of contract, conditions of breach, remedy and compensation of the contract, if all these parameters of the contract are clear between the parties then we can ensure that representative will discuss these facts with the other party and contract can be established between them. We have to ensure that representative understand all the parameters of the contact so that he or she can bind the other party in the contract.
