B. Lonchyna enlisted in the US Air Force at age 17. He subsequently applied three times for educational delays to delay the start of his tour with the Air Force. These were each granted. After the third delay application, Lonchyna asserted that the contract was void because he was a minor when he entered into it. Is the contract void?
Minors that is person under the age of 18 years have limited ability to enter into a contract.Under certain conditions the minor cease to be treated as minor in the eyes of law.Some of these conditions are as follows:
1)A person who is married under 18, is considered to have full capacity to enter in to a contract, but it may differ from state to state.
2)Emancipation :This is a legal process that takes place when a person not attained the age of majority but is still able to pay his/ her bills on own and is no longer reliant upon their parents for their needs.
3)In case the minor delays to disaffirm a contract after a reasonable point of time after attaining majority and has enjoyed the benefits of the contract entered in to within such time.
The third case may be applied here. Lochyna entered into the contract when he was 17 and he applied for educational delays to delay the start of his tour thrice. The major question that arises here is whether he has had any benefits arising out of the said delays etc.It seems that the contract was just prolonged for a period ad no additional benefits where drawn out of the same.Also it is assumed that he has disaffirmed the contract within a reasonable time.Thus the contact can be treated as void since the party was a minor.
