Mary called up her main supplier to obtain some Holiday Decorations for her retail decor store. Mary ordered a total of 100 sets of holiday ornaments that were to be hand made from glass, with each set containing a total of 5 ornaments. The total cost to Mary was $600, plus the cost of freight. Because Mary was trying to get ready for the holiday sales season, the shipment had to be delivered by 11/15. Her supplier delivered holiday ornaments on 11/12. On inspection, Mary realized that the shipment included 90 sets of 5 handmade glass ornaments, and 10 sets that were plastic. Of the 90, three of the sets were damaged, where at least one of the ornaments was broken.
Using the UCC § 2-601, discuss (a) Mary's options as to the contract, (b) what her remedies are if she accepts the goods or rejects them and (c) what you think is her best course of action and why.
When one of the parties to a contract does not fulfill the promise , we call it a breach of contract. breach of contract means the violation of contract. The party who has suffered from the breach of contract can claim the compensation for loss or damages.
Bad businesses are on a rapid rise in the world today. So we must find tools to stop such business further they have. Here the goods received by Mary were not match with promised ones. It is a cheating. So she must fight against it. Firstly, Mary should complaint it directly to the business before taking other actions. The consumers are offered ways for filing complaints against business that they could be legitimately dissatisfied with. Otherwise Mary can file it at the Consumer Disputes Redressal Forums. It is very helpful to consumers.Or she can complaint it at the district, state, or national levels depending on claim value.
I think it is better to reject the goods to the company and sue the compensation.
