QUESTION 7
Tylette lost her puppy, Vladimir. Shirley found Vladimir and
returned him to Tylette, who was thankful. The next day, Shirley
finds a poster in a local coffee shop advertising a $100 reward for
the recovery of Vladimir. She returns to Shirley to ask for the
money, but Shirley refuses.
What is the most correct statement about the outcome of this
dispute?
a. |
Although Tylette made an offer, Shirley's return of Vladimir did not constitute an acceptance because she was not aware of the offer at the time she took the action. Tylette is not obligated to pay the $100. |
|
b. |
When Tylette distributed the flier, she made an offer to the finder of Valdimir, regardless of that finder's identity. The fact that Shirley did not see the flier is irrelevant. Shirley is entitled to the $100 |
|
c. |
When Tylette distributed the flier, she made an offer to Vladimir's finder, regardless of that finder's identity. Since Shirley saw the poster within 48 hours, she accepted the offer within a reasonable time. Shirley is entitled to the $100. |
|
d. |
When Tylette distributed the flier, she did not make an offer to anyone because she did not sign the flier. She is not required to pay the $100 to Shirley. |
A. Although Tylette made an offer, Shirley's return of Vladimir did not constitute an acceptance because she was not aware of the offer at the time she took the action. Tylette is not obligated to pay the $100
Reason : this is a situation of unilateral contract. A unilateral contract is the contract that requires certain performance from other parties which is considered, from legal standpoint, as an acceptance.
Note that, it is still a contract. And a contract has three basic elements namely : offer, consideration and acceptance.
Now, can you accept an offer that you didn't even know about? NO. because an acceptance requires that the other party that us willing to accept the offer must understand the terms and conditions before accepting the offer or performing (in unilateral contract).
Shirley's return of Vladimir wouldn't be constituted as an acceptance since she didn't know about the offer in the first place and hence Tylette isn't required by law to pay the reward amount of $100 to Shirley.
