Please briefly explain Espinoza v Farah Manufactoring Co. 414 US 86 (1973)
Espinoza v farah manufacturing (1973) is the case of Cultral descrimination in which an employer's ( Farah Manufacturing co. ) refused to hire a person ( Espinoza) because she is not a United States citizen does not can employer's refusal to hire a person because he is not a United States citizen does not constitute employment discrimination on the basis of “national origin” . Espinoza who is mexicon shifted to U.S and married to the U.S citizen file a suit againt the Farah Manufacturing Co. With the help of Equal employment opportunity Commision for not hired her in the Company because of her Mexican Citizenship. it is violated the section 703 of civil right Act , in which employer Unlawful employment practise by not to hire Espinoz due to her race, caste, religion, sex. and national origin.
The Court makes the positive judgements by relying on Equal employment opportunity Commision , providing the Foreign country residents a job and not desciminated against on the basis of Nationality.
