An employer is hiring a new employee and wants to ensure that the new hire does not have embarrassing, illegal, or inappropriate postings on Facebook. To qualify for the position, applicants are required to share their Facebook login and password with employer. Is this legal in Oklahoma? Elaborate in your response - please do not give me a yes or not answer. Do all states prohibit this conduct? What is your opinion on Oklahoma law?
The new Oklahoma law prevents or prohibits the employers of the
company from demanding the Facebook credentials of new hires or new
employees.The new Oklahoma law also points out that the employers
cannot ask the employees to open or login their facebook accounts
infront of the employers which allows the employers to assess the
Facebook content of the new hires.As in other states with the
similar laws cannot deny a new hire only because he or she refused
to provide the facebook credentials.This is not the case of every
states.There are states which demands the facebook credentials of
the employees before hiring them.The new law does not prohibit the
employers from demanding the necessary personal information about
the employees. Eventhough the employers cannot ask the password of
employees social media accounts the employers can still monitor
their employees and their activities and their communications when
employees open their accounts through employer provided
systems.
I do support the Oklahoma law which prohibits the employers from
demanding the social account credentials of the employees.The
employers should not be allowed to intrude in to the privacy of the
employees.If an employers fails to hire a new employee to the job
only because he refused to give his social media credentials should
have to face legal implications.
