Expert Solution

In the instant case, let's first discuss a few relevant points to the case:

1. (a) Brett Berry visited Bayview in Savannah, Georgia.

(b) Ordered cappuccino, took receipt and while moving back to the table, noticed that donkey has been drawn in coffee cup.

(c) he fell down had injuries in back and left leg, suffering to which he filed lawsuit against the firm.

2. In this point we will discuss arguments of each, one by one:

(a)  Arguments for Brett: As Brett is filing the lawsuit having injuries as well as being mocked at thebayview. His arguments would be: I paid for the cappuccino ordered and the employee of the bayview mocked me by drawing donkey in my cappuccino ,which is weird. Also the floor of the bayview was not mopped properly resulting to injury and loss of my health.

(b) Arguments for the Employee at bayview: The cappuccino which I provided to Mr. Brett was accidentally replaced with another customer's order. I am also providing order receipt of another customer.

(c)  Arguments for the Manager: The floor was mopped by the worker properly however, the accident area might not got dried up resulting in an injury to Mr. Brett.

(d)  Argument for the Bayview: We accept that the injury caused to Mr Brett is irreparable however the issue of drawing in the cappuccino is nit relating to him.

3. On going through the above arguments and doing a tactical analysis it is clear that the Mr. Brett should be given a lead only for the damages concerning to his health i.e., injuries. However, the Hon'ble Court should warn bayview not to make mistake in providing correct order to correct customer.

James has just jumped out of an airplane. After he opens his parachute he experiences 2 forces: the constant force of gravity, and a wind drag that is proportional to his velocity. His height may therefore follow the equation: d2h/dt2 = -9.8 - 2(dh/dt). As a second-order differential equation, this is not technically solvable by separation of variables. However, because the variable h appears only in its derivatives, we can turn this into a first-order equation, and solve that by...
