Critically examine the main features of the Australian legal system;
Main features of Australian legal system include:
i)all people should be traeted equally under the law;
ii)Courts and Judges must be independent and impartial.
Various processes and procedure exist within Australian legal system to help make sure that all people who have dealings with the police,courts and other legal authorities,are treated equally regardless of their personal circumstances or background.
Unfortunately some groups with in Australian society including Indigeneous Australians,people from cultural and linguistically diverse communities-such as migrants,refugee,and asylum seekers-and people with mental health issues or intellectual disabilities,often experience difficulty when dealing with the legal system.
Being independent means that the courts are separate from the elected parliament and government ,and the judges and magistrate are therefore free to make decisions without these bodies trying to influence them.The judge also makes sure that both parties have an equal opportunity to present their case be ensuring each follows the strict rules of evidence and procedures,when presenting their case to the court.
