The Intersection of law and science: John is a mechanical engineer. He has designed a car which uses water rather than fossil fuel to run. Explain wheather John invention is eligible to be patented.
There are three requirements that need to be passed to be patented
Patentable subject matter: In this process the information about the machine, manufacture or composition of matter here car, John has designed a car, it does pass the “subject matter test as john has designed the car.
2) Usefulness: this process states that the product should be beneficial to all of society-Since John’s car is using the fuel in the car which is environment friendly meaning it would not be using fossil fuel to run, it Will reduce the pollution so it will pass the “usefulness” test.
3) Nonobvious: To pass this test the invention must not be “obvious” to anyone in the same field as John meaning the product should be exclusive John's competitors would have to prove anyone who had the same skills as John would have seen that it would have been obvious to try the same innovation that he did. In this case john's car might not be patented.
